Terms for this website.
These terms are the agreement between you and actVite for using actvite.com. actVite operates from Ontario, Canada. If you do not agree, do not use the site.
The site
The site describes research work: custom model training, local hosting, private embeddings and vector databases, private retrieval, language and decision models in electronics, and custom 3D printing. Pages are information. They are not an offer, a quote, or a promise that a particular result can be built.
No engagement yet
Sending a brief does not create a project, a retainer, or a duty of confidentiality beyond ordinary care with a message you chose to send. Research, training, hosting, electronics, and printing start only when both sides sign a separate written agreement that says so.
Acceptable use
You may read the site and send a brief. You may not misuse it. That includes trying to break the site, probe it for someone else’s data, overload it, or use it to send unlawful, infringing, or deceptive material. We may refuse a message and may block traffic that threatens the site.
Your brief
You are responsible for what you put in a brief. Do not send secrets you are not allowed to share. The message leaves your mail application, not a form stored on this site. We may use what you send to reply and to decide whether the work is something we do.
Intellectual property
The site’s text, layout, and graphics belong to actVite or its licensors. You may link to the site. You may not copy the pages and present them as your own. Models, data, and hardware made under a later agreement are covered by that agreement, not by these website terms.
Third parties
The site uses Cloudflare, including for analytics. Cloudflare’s own terms and privacy policy apply to what Cloudflare does. Links, if any, to other sites are not an endorsement, and those sites have their own terms.
Disclaimer
The site is provided as is and as available. To the extent the law allows, actVite disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the site will be uninterrupted or error-free. Research descriptions are general. They are not engineering advice for your device until a separate agreement says they are.
Limitation of liability
To the extent the law allows, actVite is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the site, even if advised that such damages are possible. If liability cannot be excluded, it is limited to the amount you paid actVite to use the website in the three months before the claim. Use of the website itself is free, so that amount may be zero. These limits do not apply where the law forbids them, including liability that cannot be limited for fraud or for injury caused by gross negligence.
Law
Ontario law and the federal laws of Canada that apply in Ontario govern these terms. Courts in Ontario have exclusive jurisdiction, except that either side may seek an injunction in a court that can grant one.
Changes
We may update these terms by posting a new version on this page with a new date. The version in force is the one posted when you use the site. A change does not rewrite a separate written agreement already signed.
